Guidelines for Broker Comments on BrokerCheck

An individual who is not currently registered with FINRA, but for whom a BrokerCheck report is available, may submit a Broker Comment Request Form to provide an update or add context to information disclosed through BrokerCheck. Therefore, all individuals who have been FINRA registered within the last 10 years, and any individual whose last FINRA registration terminated over 10 years ago and who has been (1) the subject of a final regulatory action; (2) convicted of or pled guilty or no contest to certain crimes; (3) subject to a civil injunction involving investment-related activity or found in a civil court to have been involved in a violation of investment-related statutes or regulations; or (4) named as a respondent or defendant in an arbitration or civil litigation in which the individual was alleged to have committed a sales practice violation, and which resulted in an award or civil judgment against the individual, may submit a Broker Comment. Individuals who are currently registered with FINRA and wish to provide an update or add context to information disclosed through BrokerCheck are required to file an amended Form U4 via Web CRD.

 

An individual may submit a Broker Comment to FINRA by mailing a completed, signed and notarized Broker Comment Request Form, along with the section(s) of his or her BrokerCheck report for which a comment is requested (highlighting or circling the specific section is sufficient). FINRA will review the comment and add it to the individual’s BrokerCheck report if FINRA determines that the following criteria have been met:
 

  • The individual submitting the comment is not currently FINRA-registered.
     
  • The comment pertains to the BrokerCheck report of the individual submitting the request.
     
  • The comment addresses information disclosed through BrokerCheck.
     
  • The comment is written in the first person narrative point of view in order to minimize any potential confusion on the part of the reader.
     
  • The comment does not contain confidential or identifying information about customers or others; offensive or potentially defamatory language; or information that raises significant identity theft, personal safety or privacy concerns.

 

FINRA reserves the right to reject comments or redact certain information, on a case-by-case basis, that it deems to be inappropriate.

 

Broker Comments that meet FINRA’s criteria generally will be posted to BrokerCheck within 30 business days of receipt. The Broker Comment will be displayed in BrokerCheck as long as the report is available to the public. An individual may replace or delete a previously submitted comment by submitting another Broker Comment Request Form. If an individual becomes FINRA-registered, a previously posted Broker Comment will no longer display through BrokerCheck and the individual must provide any information that was the subject of the Broker Comment via a Form U4.
