Proposed Amendment to the Customer, Industry and Mediation Codes to Implement Technical Changes to the Three New Codes Prior to the Effective Date of the Customer and Industry Codes

NASD, through its wholly owned subsidiary, NASD Dispute Resolution, Inc. ("NASD Dispute Resolution"), is filing with the Securities and Exchange Commission ("SEC" or "Commission") a proposed rule change to amend the NASD Code of Arbitration Procedure for Customer Disputes ("Customer Code"), NASD Code of Arbitration Procedure for Industry Disputes ("Industry Code"), and NASD Code of Mediation Procedure ("Mediation Code"), to delete rule language that was rescinded prior to the approval of these three Codes, to change a reference that was amended by a separate NASD proposal, and to insert rule language that was approved by the SEC prior to its approval of the Customer and Industry Codes, but was inadvertently omitted from the Customer and Industry Codes.
