FINRA Alerts Firms to Recent Increase in ACH “Instant Funds” Abuse
FINRA warns member firms that, over the past two months, we have observed a sharp increase in new customers opening online brokerage accounts and engaging in Automated Clearing House (ACH) “instant funds” abuse to effect securities trading. FINRA urges firms to evaluate and, as appropriate, mitigate the potential financial risk they face in light of the increase in “instant funds” abuse. This could include adjusting the amount of available “instant funds,” delaying the ability to place orders with unsettled funds or by enhancing their account validation processes. See Regulatory Notice 21-14 for additional information.
2021 Advisory Committee Overview and Engagement Notice
FINRA has multiple committees that facilitate effective engagement with its member firms and representatives of the public regarding regulatory and policy initiatives related to FINRA’s mission of promoting market integrity and investor protection in a manner that promotes vibrant capital markets. The purpose of Special Notice 3/26/21 is to encourage employees of member firms and other interested parties with diverse skills, backgrounds, perspectives, and experiences who will provide innovative feedback and support FINRA’s mission of investor protection and market integrity, to become involved in these committees. Interested individuals should use FINRA’s Engagement Portal to submit an online form to be considered for future committee vacancies.
