To whom it may concern, I strongly oppose any potential restrictions on my ability to purchase leveraged instruments. This would be another way for the large institutions to use investment vehicles for their advantage at the expense of the smaller investor like me and put us on unequal playing ground. I do not use them as a large part of my portfolio, but use them for hedging or taking advantage of optimal market conditions. Please do not impose special tests for these instruments. At the most, they should be similar to those for options trading.

Please do NOT restrict the use of leveraged ETFs in ANY way. Just this proposal is outrageous: You think only rich and privileged people understand risk? How condescending is that? Leveraged ETFs are the only way for middle class investors to have a decent shot of moving out of the middle class as we aim to become financially independent. Almost all retail investors understand the risk and volatility involved in these ETFs; we still want to invest in these leveraged products (especially leveraged bull market products) only because this is our only chance to become financially independent.

My name is Brian and I am a retail investor. I do not have a background in finance or economics and I do not have any SEC certifications. I have 3 trading accounts; a joint brokerage, an individual brokerage and an IRA. The combined balance of these accounts is about $300K. I am in my 40s and no longer hold my corporate job. I am self-employed and chose to invest my own retirement and cash/margin funds. I exclusively trade in Leveraged & Inversed ETFs/ETNs and have been doing so for several years. It is simply un-American and wrong to restrict access to certain investment vehicles simply because FINRA has generalized that the average retail investor is incapable of comprehending the products in which they invest in. From someone who has been studying leveraged funds for years now, please do not do this. One could argue that investing in small biotech stocks or "Bottom Fishing" stocks is riskier than some of these funds. But does that mean we should be restricted from doing it? Of course not. Add more disclosures, make people attend a class once, but please do not do this.

Everyone should have the same opportunity to invest and better themselves. It should not be controlled by a few. The market used to closed for a long time to the average investor and when it opened it made things more transparent. I think this is what is happening here. They are trying to close the market to the individual retail investor and make it exclusive again. This might be a result of the Reddit groups who turned the tables on the institutional investors and created hugh losses for the institutional investors. Instead of more exclusivity we need more transparentcy in the market.
