The mid-month short interest report is based on short positions held by members on the settlement date of the 15th of each month. If the 15th falls on a
(a) If a participant of a registered clearing agency has a fail to deliver position at a registered clearing agency in a non-reporting threshold security for 13 consecutive settlement days, the participant shall immediately thereafter close out the fail to deliver position by purchasing securities of like kind and quantity.

The Daily Short Sale Volume Files provide aggregated volume by security for all short sale trades executed and reported to a <a href="/filing-reporting/trade-reporting-facility-trf">TRF</a>, the <a href="/filing-reporting/alternative-display-facililty-adf">ADF</a>, or the <a href="/filing-reporting/over-the-counter-reporting-facility-orf">ORF</a> during normal market hours for public dissemination purposes (i.e., media-reported trades).
Pursuant to applicable trade reporting rules, members must indicate on trade reports submitted to FINRA whether a transaction is a short sale transaction ("short sale reporting requirements"). The short sale reporting requirements apply to transactions in all OTC Equity Securities, as defined in Rule 6420. Thus, all short sale transactions in these securities reported to FINRA must

Because a large number of American investors are approaching retirement and control a substantial portion of investment assets, FINRA encourages firms to review and, where warranted, enhance their policies, procedures and practices, in light of the special issues common to many senior investors. For example, a firm's procedures and controls should take into consideration the age and life stage (whether pre-retired, semi-retired or retired) of their customers. Of particular concern to FINRA is the suitability of recommendations to senior investors, communications targeting older investors, and potentially abusive or unscrupulous sales practices or fraudulent activities targeting senior investors.
