You think you’re arguing from a position of strength. You think asking for the public to comment you’re assuaging the masses. You think we think you’ll actually do something honorable and equitable in response to this open comment forum. We know better. It’s all coming out now. Again. It's unfair that large financial institutions would be allowed to use leveraged instruments while small retail investors would not. FINRA is supposed to protect a fair market but this would only make the market more unfair. Why should FINRA tell me how I can invest my money?
Having access to Leverage ETFs and leveraged inverse ETFs gives access to the retail investors the tools available financial professionals. It levels the playing field. It gives the ability to accelerate and hedge our investments. Removing or limiting this access is very unjust to the retail investors. Please make it a level playing field.
I wanted to comment regarding the regulations being considered by the Financial Industry Regulatory Authority (FINRA). I have utilized the leveraged funds and I understand how they work. I do not feel that it is necessary to go through any special training or monitoring to trade with these funds. I oppose restrictions regarding my right to invest in public investments.
The financial markets are undemocratic enough. Please do not restrict investors in favor of professional institutional investors. These instruments are used for risk management, hedging enhancing returns of smaller investors and leveling the playing field given wash sale rules, margin requirements and those who do not want to invest in options.
Individual investors have the right to freely decide for themselves what securities they want to invest in and what their risk tolerance is to achieve their long term financial goals, without arbitrary restrictions by FINRA. ANY LEGISLATION TO IMPOSE LIMITATIONS OR RESTRICTIONS ON INDIVIDUAL INVESTORS RIGHTS TO FREELY CHOOSE THEIR INVESTMENTS WILL BE MEET WITH FEIRCE OPPOSITION
Financial Industry Regulatory Authority, Inc. (“FINRA”) is filing with the Securities and Exchange Commission (“SEC” or “Commission”) a proposed rule change to amend Rule 2360 (Options) to increase the position and exercise limits for conventional options on certain exchange-traded funds (“ETFs”).
Government regulations need to stop interrupting American citizens lives by taking away our freedom of choice and speech. We should be able to invest as freely as anyone else no matter their status or financial state. Free to choose is the right of ALL Americans. You have no right to take this away from anyone!!

I am a Certified Financial Planner with 30 years of experience. These producs must be allowed to be traded by the open public. Any restriction is bad for the markets and the consumer. It is up to the consumer, not the government to make these decisions. There is more than enough information available to consumer regarding any potential risks. They can asses the risk themselves.
