William Fox Comment On Regulatory Notice 22-08

I should be able to choose the public investments that are right for you and your family. Public investments should be available to all of the public, not just the privileged. I shouldn't have to go through any special process like passing a test before you can invest in public securities, like leveraged and inverse funds. Explain that I am capable of understanding leveraged and inverse funds and their risks. I do not need these measures imposed on you.

To whom it may concern.

Leveraged ETFs have been an important part of my investing strategy for years. I am aware of the risks and the benefits to my overall investment goals. I have used them to consistently outperform professional mangers.

It is unfair that you would take the public's right to participate in the market and restrict it to the privileged. Please let us continue to trade on an equal playing field.

In light of the new proposed regulation that ProShares has made me aware of I thought I should make my feelings known. There are many complex investment opportunities, and it is incumbent on the investor to educate himself on the risks. The government should protect us from fraud but not from ourselves. I am a free man, a living soul with a mind to make my own choices. Well written disclosures may be the solution. Regulation and restriction by the nanny state is never the solution.
