Boris Bernstein Comment On Regulatory Notice 22-08

Creating additional layers of testing and regulations around existing investment products, especially equity types that have been around for years and are widely used, does not add any value to the existing and new investors. Every investor has it's own right to select his/her own investment options, including inverse, leveraged or cryptocurrency ETFs to name a few. Every investor already educates themselves on the risks and benefits involved with each investment.

Hi FINRA Committee Members, I don't believe it is fair that you are trying to regulate leveraged and inverse funds. I understand the risks in using them, and have used them successfully in the past. I find them to be easier trading vehicles than using options and I use them as a way to keep my portfolio hedged and to play short term swing trades during uncertain times. If others don't know how to use them properly, that's on them, and I'm sure they'll learn quickly if they lose money by not knowing what they are getting into. Please reconsider restoring access to these funds.
