Acceptance of These Terms
The Financial Industry Networking Directory (FIND) comprises of certain online services provided by FINRA, including but not limited to: (1) a directory of individuals who have opted into having their information distributed for recruiting purposes to financial services firms and companies; (2) materials to educate individuals about careers and the requirements for obtaining registration in the financial services industry; (3) services supporting individuals with recruitment and entry into the financial services industry; and (4) information distribution services to support financial services firms and companies with recruiting potential employees and contractors.
Copyright, Trademark, and Proprietary
The FIND shall be used ONLY for Your own non-commercial personal use. You grant FINRA a non-exclusive, perpetual, irrevocable right and license to reproduce and distribute any content or material posted on FIND while opted into the service.
Rules of Conduct
You may NOT:
a. use in violation of applicable laws or regulations;
d. provide information to the Find Service that, to the best of Your knowledge, is untruthful, inaccurate, or out-of-date;
d. use statements that are bigoted, hateful, or racially offensive;
e. post material that contains obscene language or images;
f. use any process to monitor or copy, reproduce, distribute, publish, or transfer the FIND Service, or use any data mining, scraping, or harvesting tools (including robots), or any similar data gathering or extraction tools;
g. use any device, software, or routine to bypass any software or hardware that limits the volume or frequency of requests for the FIND Service;
h. attempt to interfere with the proper working of the FIND Service, including taking any action that imposes an unreasonable or disproportionately large load on the FIND Service (including by making voluminous, excessive, or repetitive requests for data);
i. introduce a virus or other malware to the FIND Service;
j. use FIND or Licensed Marks in a manner that infringes, violates, or misappropriates FINRA’s, its affiliates’, or a third party’s intellectual property rights;
k. use FIND to disseminate unsolicited advertising or promotional material of any kind or that may be confused with communications of FINRA, its officers, or employees;
l. use FIND in a manner that implies endorsement, approval, or sponsorship by FINRA; or
m. use FIND in any manner that disparages FINRA or is otherwise threatening, vulgar, or inappropriate as FINRA determines, in its sole discretion.
Disclaimers; Limitation of Liability
a. YOU ACKNOWLEDGE AND AGREE THAT THE FIND SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND THAT YOUR USE OF THE FIND SERVICE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, FINRA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, AND LICENSORS (THE “FINRA PARTIES”) DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE FIND SERVICE AND YOUR USE THEREOF.
c. IF ANY PORTION OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF THE FINRA PARTIES SHALL NOT EXCEED $100.
d. FINRA makes no WARRANTIES, REPRESENTATIONS, OR guarantees, expressed or implied, that your participation in the FIND service will result in your information being distributed to, OR OTHERWISE VIEWED BY, FINANCIAL SERVICES FIRM or COMPANY subscribers, or THAT YOUR PARTICIPATION will ensure YOUR consideration for contract, employment, and/or internship opportunities.
e. FINRA, IN ITS SOLE DISCRETION, reserves the right to remove YOU FROM the FIND service at any time and/or have YOUR participation preference changed to opted out without user interaction.
Nothing in the FIND Service shall constitute an endorsement, representation, or warranty by FINRA with respect to any third party, including, but not limited to, with regard to a financial services firm or company’s hiring, employment, or recruiting practices.
