John Weis Comment On Regulatory Notice 22-08

I am writing concerning the proposed restricting investors access to complex products such as ProShares inverse funds. I have been using such funds as a hedge on my common stocks, so far with great success. The decline in my stocks has been more than offset by gains on my inverse bond ETFs. As a small investor my only access to derivatives is through such funds and restricting access would greatly limit my ability to hedge my investments. As a result, I oppose any such move by FINRA.

Dear FINRA,

Your proposed rules for trading leveraged products especially net worth restriction will make rich become richer and poor become poorer. Rich will always have resources to meet regulations while poor will struggle to find time and resources to satisfy the regulations.

You should trust people to make decisions that fit their investment objectives regardless of their net worth.
