I firmly believe everyone should be given the chance and freedom to invest in what they like as long as the risk is disclosed to them and they understand the risk. In my case I believe I fully understand the risks of leveraged ETFs before making my investments. Removing this freedom will definitely harm the efficiency of the market. Even if people's freedom in investments is reduced, there are always some investors nevertheless who will lose money regardless of products.

I strongly oppose any restrictions on the trading of any of the fund types in the notice particularly leveraged and inverse ETFs or ETNs involving indices or volatility. Risks are clearly laid out in the prospectus. Not the governments job to restrict the freedom to invest in these products in order to protect people who cant be bothered to read the prospectus and then get burned by risks clearly outlined in said prospectus.

Risk is associated with everything in life, such as driving a vehicle, going to college or entering the workforce, or even accepting a job promotion. We make decisions such as requiring auto or home owner insurance. If I already understand the amount of risk of my investments, I do not need an exam to tell me how to invest. By maximizing my return on a diversified leveraged fund (such as UPRO - 3X S&P 500), it allows a small part of my portfolio balanced towards different growth potentials.
