Evelyn James Comment On Regulatory Notice 22-08

I oppose restrictions on my right to invest in any public investments I choose and feel it is very unfair to hold these funds back for just the privileged. I am capable of understanding the risks involved by investing in leveraged and inverse funds and do not need to pass a test before investing. Trading the inverse funds in recent months has enhanced my returns a great deal with so much fluctuation all through each day; of course I've used them only as a very limited part of my overall portfolio.

Before you restrict or remove an investors right to buy leveraged or inverse funds, you should consider that this structure allows educated investors to make these decisions without having to personally handle the underlying pieces that create these investments possible. Removal of these funds would not remove the risk, it would increase the risk as individuals do puts, calls, straddles, etc to have the desired investments.
