Michael Torrance Comment On Regulatory Notice 22-08

Investing in a publicly offered security is my choice. I should not have limitations on what I can choose to invest in just because something is considered leveraged. Reducing the availability of publicly offered securities is pointless. I understand the risks with buying a leveraged fund as anyone should when buying into an investment vehicle. Do not handicap me because of your assumption that others can't handle leverage.

It's especially important regulators hear from you in your own words. Please use the body of this email to customize your response I feel strongly that every American has the right to dream and to try to make that dream come true. Government is overreaching. Government, you were hired by the common folk, You all become millionaires in service of your country. why do you feel we don't deserve a piece of the pie? Leave us alone

I not regulators should be able to choose the public investments that are right for me and my family. Public investments should be available to all of the public, not just the privileged. I shouldn't have to go through any special process like passing a test before I can invest in public securities, like leveraged and inverse funds. I am capable of understanding leveraged and inverse funds and their risks. I do need these measures imposed on me. Leveraged and inverse funds are important to my investment strategies, and is an important element of my investment portfolio.

I am capable of understanding leveraged and inverse funds and their risks. They are an important part of my portfolio that fall into the category- high risk. Dont try to overreach and keep these funds available to all.

I have been successfully investing in leveraged ETFs for over 10 years now. I currently hold a significant position in TQQQ with unrealized capital gains that I can't afford to pay taxes on until after I retire. I need the liquidity of of an active options market on this leveraged ETF to be able to sell options against my position in times of excess volatility. I cannot afford to change my investment strategy at this stage of my life. I find leveraged ETFs to be much safer and more cost efficient than constantly trying to make leverage positions in the options market.
