Stephen Kiely Comment On Regulatory Notice 22-08

I am a retiree living on the income from my investments. Federal Reserve policy has all but stripped me of the ability to invest simply (bonds) to achieve reasonable returns to cover my living expenses. I rely on leverage in equity funds to make the returns I need. I'm required to be more sophisticated as an investor because of federal policy that ignores my needs coupled with predatory taxation. We DON'T NEED FURTHER BURDEN ON RETIREE INVESTORS.

I'm very disappointed to hear that regulators may restrict our ability to trade publicly traded inverse funds. I use these funds regularly to hedge a small part of my total portfolio to add protection in a declining market. I am aware of the risks of doing this, just as I am aware of the risks of investing in an publicly traded security. Restricting the purchase of these leverage funds would likely mean I would have to learn and understand using options to hedge my risk. This appears to be a much more complicated process.

I want to be able to choose what investments are right for me. I want these funds to be available to me to choose from. I'm capable of understanding leveraged and inverse funds and their risks. These funds are an important part of my investment strategy. They help me protect my investments some times and some times give me better returns and use these as certain part of my investment mix. I seriuosly hope I don't have to go thru any hoops to be able to do this.
