Steven Trojanek Comment On Regulatory Notice 22-08

Do you remember the tax act of 1986, it took back what was granted to investors in the 1981 tax act and slammed the entire economy into reverse for about five years. This is the same kind of action.

I would not use inverse ETFs, or short market.

I keep the exposure as s small portion of an overall portfolio, and have a large cash balance. So, using these, I can keep cash % larger.

Biggest single equity position: Berkshire Hathaway, since 1995.

I am strongly opposed to these restrictions being considered for leveraged and inverse funds.
Regulators should not be able to restrict or limit public investments that are right for me and my family.

Restrictions like passing a test before I can invest in public securities such as leveraged and inverse funds are unnecessary. I am quite capable of understanding leveraged and inverse funds and their risks.

Hello FINRA, I have been using leveraged ETF's in my portfolio using a strategy based on an algorithm that helps me decide when to buy and sell and I have been successful using this strategy. I have a firm belief that I, not the regulators should be able to choose the investments that are right for myself and my family. Public investments should be available to all of the public, not just the privileged few.

I am opposed to any legislation preventing me from trading these types of securities. I have been trading options for 15 years, and have been trading leveraged and inverse etfs for at least 10 years. I know how they work and have studied these vehicles at length. I studied options and used practice accounts over 15 years ago before I ever used options. I use options and leveraged etfs as investment vehicles and as insurance/protection. I never put all my money in one investment. When I use options and leveraged etfs, I only use a certain percentage of my total portfolio.
