I am strongly opposed to any new regulations that would hinder an investor's ability to navigate today's complex markets. Tools such as leveraged and inverse funds are critical to the ability to hedge a portfolio. In fact, I find the existing rules to be somewhat arbitrary and onerous.

More regulation does not help the individual investor but rather, undermines their ability to mitigate risk and serves only the interests of large incumbent institutions.

As an informed and educated professional, I should have the right to invest in whatever funds I please. Leveraged ETFS in particular do not pose a risk to my personal financial freedom or wealth. As someone who has read the prospectus of UPRO, TQQQ and TMF, I feel that it is my right as an American to express myself freely supporting these leveraged funds. I know the risks that come with these funds, and they allow me to seek advantageous returns while not risking more than my initial capital investment.

Regulators - Please do not restrict the ability for the average investor, like myself, to invest in "complex" products. "Complex" products is subjective to everyone and would be disadvantageous to the average investor. I would rather make the decision myself and learn from my mistakes than having regulators dictate what is best for me. For example, anyone of age is able to buy "sin" products (e.g., alcohol, tobacco, etc.) but are NOT there restrictions on the "harder" or "more concentrated" products.

I, not regulators, should be able to choose the public investments that are right for you and your family. Public investments should be available to all of the public, not just the privileged. I shouldn't have to go through any special process like passing a test before you can invest in public securities, like leveraged and inverse funds. Explain that you are capable of understanding leveraged and inverse funds and their risks. Leveraged and inverse funds are important to my investment strategies. and if I use them as a limited part of your overall portfolio.

Any changes to existing regulations may result in the closure of some of these leveraged funds which could result in major realized losses with no easy way of reestablishing the position. Additionally any impact to ETPs would likely result in investors having to resort to margin which is vastly more risky (due to margin calls and high interest rates). I strongly oppose any additional regulations that limit access to these funds.
