Dear FINRA,

I am hereby writing to object to the rule enhancement articulated on Regulatory Notice 22-08, which proposes a restriction on investors' ability to trade complex products and options.

I clearly understand your concern about investors making uninformed investment decisions on options and complex products specifically to leveraged or inverse exchange-traded products. However, a restriction on trading complex products will do more harms than goods.

I oppose any regulations that would restrict the average investor from utilizing ETFs and other products that should be available to the public. Particularly when these products will be restricted to persons of high wealth. This is a blatant attempt at preventing persons of a lower income bracket from generating personal wealth and should be considered segregation of classes.

Individual investors did not blow up the economy in 2008 with the use of leveraged investments they didn't understand, over-leveraged financial institutions (and the credit agencies that bodies like FINRA failed to regulate) did. Are you planning on prohibiting those same financial institutions from using leveraged investment or are you going to once again bend retail over in the guise of "our best interests"?

I oppose the leveraged/inverse ETF restrictions proposed in this regulation, which would disadvantage individual investors and greatly limit investment opportunities.

Leveraged ETFs are very helpful financial tool for retail investors. They are important to my investment approach. It provides investors access to a basket of stocks and in general it has protection against short raids by hedge funds. Please keep these important investment options around. DO not make retail investors even more weaker by taking this tool away from them.

Leveraged fund investment has allowed me to protect my current investment without selling of my current investment. Purchasing leveraged inverse funds hedges my current investment from severe losses without significant capital needs. They are simple and easy to purchase. Limiting access would increase the cost of Government, and allow for only the big players to take advantage of the opportunities they provide. This advantage would make for an even more unfair playing field in securities investment. I beg that Government please keep the markets open for the little guys!

I don't think it's right to limit access to leveraged products. The people should have the ability to make their own decisions with their own money. Creating barriers to entry based off tests or net worth is why there is huge wealth inequality. In the past only the privileged had access to investing in general and now that we've made so much progress in allowing regular people to invest and have access, you all want to take that away and erode years is progress.

In regards to restricting people's ability to invest in leveraged and inverse funds. I will chose to believe that this is a well intentioned regulation to prevent people who may not know what they are doing from losing big in a down turn. But this also disallows poor people and those who may be just starting out, the potential for higher returns on their investments. This would take away my ability personally to invest in these funds even though I understand them well and have personally benefited greatly from investing in leveraged/inverse funds.

These regulations will more broadly effect individual investors and again give more advantage to institutions which already have significant advantages in the market. It is my decision if I wish to invest in leveraged stocks. You can help educate individuals but to take their decision making away from them is unlawful, Especially when my right to invest is not imposing on the rights of other individuals.
