George Goss Comment On Regulatory Notice 22-08

I am an individual investor who essentially manages my own portfolio. I use individual stocks, mutual funds, ETFs and KNOW THAT IT IS MY OWN RESPONSIBILITY to do my OWN homework and KNOW my investment choices including the risks and potential rewards. I also use leveraged ETFs where I CONSIDER APPROPIATE and DO NOT WANT ANY ADDITIONAL REGULATIONS AND EXTRA STEPS IN THE BUYING AND SELLING PROCESS.

My wife and I are perfectly capable of understanding the risks associated with investing, including leveraged and inverse funds. We've done our research and we do not need nor do we desire any government intervention, prohibition, or restrictions imposed on our investment strategy. Leveraged and inverse funds are important to our investment strategies. We include these fund types to help protect (hedge) our investments and seek enhanced returns, they are an important and limited part of our overall portfolio.

I wish to express my opposition to FINRA's proposed regulations from purchasing securities designated as complex products such as those on cryptocurrency. I do not own any cryptocurrency but I do own leveraged stocks and ETF's and other securities which may be classified as complex products. As a knowledgeable investor, I am qualified to assess the risk of securities I purchase and I have a fundamental right to invest my money in any security that meets my risk tolerance. Please do not restrict or limit this right.

I should be able to choose the public investments that are right for me---not the regulators. Public investments should be available to everyone. I shouldn't have to go through any special process like passing a test before I can invest in public securities like leveraged and inverse funds. If you limit public investments like leveraged and inverse funds to the general public, it's excluding a strategy that is useful for overall portfolio management. I use leveraged and inverse funds frequently and I understand their risks.

These so-called complex investments should be available to everybody. If a losing bet like a lotto ticket or a casino is available to everybody, then TQQQ should be available to everybody. Leveraged ETFs are pretty simple to understand. 3 times the Nasdaq100s returns? Yes, please! Ultimately we should be free to use our money however we want when it comes to investing. Do the people at FINRA even understand TQQQ? Were in the trenches and theyre on the sidelines. We are all adults here, so please stop treating us like children.
