Robert McKerley Comment On Regulatory Notice 22-08

I strongly oppose FINRA Regulatory Notice #22-08 I am fully capable of deciding what investments are right for me. I do not need the government to impose more regulations and take away my RIGHT to invest as I see fit.
Leveraged funds are an integral part of my investment plan, especially in a down market as we have had recently. I urge you to not pass these new requirements. We need LESS, not more government interference with our life!

My broker notified me re: a proposal that would force me to qualify to trade a public security focused on cryptocurrency. I oppose any type of qualification to trade these securities. I understand
cryptocurrency funds, such as BITO, and their risks, and i limit my total investment in such securities to about 1-2% of my portfolio. I know how to be cautious, and do not need government regulation to interfere with my public investment choices.

Please keep your rules out of my investment strategy. I invest for myself and the well being of my family and leveraged funds are a significant part of my strategy. It is inappropriate to exclude the general public from investment vehicles that are available to the elite. It is also quite possible for anyone with more than an 8th grade education to understand risk and leverage.

Using inverse indexes and leveraged funds is a key component of my investing strategy. It has helped immensely in the early portion of this year with significant market declines. My accounts are performing well ahead of the market. This has been true in the past several years through the use of both leveraged and inverse funds. Please allow me to continue to use these funds without proving my investment ability.
