I often use leveraged and inverse funds to hedge my investments at a cheaper cost/risk than using options. They have been an important part of my portfolio when the markets are facing volatility and have allowed me to not divest from other securities through market uncertainty. I am well aware of the risk involved and how they function. I do not need protection from myself and my investment decisions.

I disagree with the notion that only high net worth investors should be qualified for leveraged ETF products. While you are seemingly attempting to protect unsophisticated investors from having to deal with losses, you are simultaneously broadly removing investors with a higher risk profile whom understand the risks, from participating. Discrimination masked as protection in other words.

I am very concerned about the proposed regulations on complex products that could potentially put restrictions on the very important investment tools of leveraged and inverse funds. We as individual investors should have unrestricted access to any public investment of our choice. These investment tools provide critical means of balancing one's assets to maximize gains and minimize losses. There should not be any "test" required to access these tools.
