Michael Oconnor Comment On Regulatory Notice 22-08

Why is it that the government thinks they know what's best for me and I don't. In a country that is rapidly losing the basic freedoms promised to us, now you want to take away my financial freedoms. Inverse funds help me protect capital during periods of turmoil, high inflation, geopolitical risks, and government overspending, to name a few. Leveraged funds allow me to hedge my positions quickly, as I did during the pandemic crash and the financial crisis of 2008-09. It is not hard to understand these are short term instruments. I use these tools to hedge my stock positions.

Use your regulatory powers to stop insider trading. Use your regulatory powers to stop inflation. Use your regulatory powers to stop Musk buying Twitter, or other monopolistic situations of which there are many. Stop harassing the small investor. You remind me of the police cracking down on jay-walking. Try to use your powers for something worthwhile, instead of on petty populist actionism like this, pathetic: noone will respect you for it.

I wanted to further add that I do not agree with restrictions being placed that would limit access of public investments to the broad public and give access only to a select group of investors deemed worthy. Personally, I use such products not only as a way to enhance returns that could help secure my financial future, but also as a hedge (risk mitigating measure) to help protect my investments. Losing that ability would handcuff me from these key strategies that I employ within my portfolio.
