James Falkner Comment On Regulatory Notice 22-08

Please allow my research and judgement to decide the best investment vehicles for my money. All tools require effort and time to learn. None are more complex than others. ETPs like Inverse ETF funds go the opposite direction of a benchmark. How is this difficult to understand? In fact, in my ROTH IRA this is the safest means to hedge against the market going lower. I don't want to go through special approvals or tests to buy any ETP such as an ETF. Their purpose, objective & method of operational are clearly explained.

James Christy Comment On Regulatory Notice 22-08

In September 2022 I will have been retired 10 years. Leveraged ETFs have made it possible for me to continue my preretirement lifestyle while being able to be generous to my children, their spouses, grandchildren, and great-grandchildren. I have also increased my retirement savings while doing this. It would be unfair to change the rules and exclude me because I am not worth enough.

Erik Haberger Comment On Regulatory Notice 22-08

Leverage and Inverse ETFs are clearly described in the prospectus(s) and in my experience the returns have been exactly inline with the stated objectives of the fund. It is important that the playing field be FAIR - and to me, that means that individual investors should have access to the same products as professionals.

Christopher Bruns Comment On Regulatory Notice 22-08

Leveraged funds have become an important part of my investment strategy. Adding any sort of limitations or restrictions on my ability to utilize these investments will have significant negative impacts on my ability to participate in financial markets which I believe should be open to all. The focus should be on investor education and risk disclosure, not limiting access based on an arbitrary list of investor qualifications.
