1. Can your broker refuse to go through the mediation process?
Mediation is voluntary for all parties. There is no requirement that any party agree to mediate. However, parties can also agree to mediate at any time. If you file a claim in arbitration, you and your broker may agree to mediate later in the process.
2. Can I still participate in FINRA mediation if I live overseas?
Mediation is a voluntary process. All parties must agree to the mediation and to the terms (date of the mediation session, location, etc.). All parties could agree to have the mediation conducted by telephone. We have many mediators on our roster experienced at conducting telephone mediations. If all parties agree, you may also request to have your case mediated in either our London or Puerto Rico hearing locations. FINRA has experienced mediators available for appointment in both locations.
