Gustavo Fernandez Comment On Regulatory Notice 22-08

Dear Regulator,

I should have the ability to invest in the kind of security I want. I have deep understandings of what these kind of products are as I have been in the financial markets for long enough. I do not invest big portion in this type of products but are of vital importance for my investment strategy. I use inverse funds which bring a huge opportunity in times like this when the market is falling. In fact this is one of the easiest ways for me to buy a hedge without going into more complex products such as options.

Thanks

Gentlemen, I am puzzled! Wall Street already has a clear advantage over the retail investor on multiple fronts including and not limited to, research, software, the speed of execution, inside information and in politics. Let us not forget the Robinhood fiasco the past year which was just one example of how markets are manipulated and front-run against the individual investor. Knowing these facts, why does FINRA want to further handicap the retail investor?

I have over 20 years of investing/trading/option buying and selling experience and 10 years using leveraged funds. I am opposed to any investment restrictions. It is up to us individuals to manage our money properly, educate ourselves on investing, limit risk, and choose the right investment that fits our income or net worth. Some people may choose to gamble on high leverage investments, but these same people can also go to Las Vegas and put it all on black. Others, like myself, are very structured in how they invest and rely on the returns of higher leverage investments.

Dear Mr/Ms,
I oppose restrictions on buying and selling certain investments ie. leverage 2X, 3X and inverse funds.
The investor should be able to choose what
investment makes sense to him and give him flexibility for growth and protection. It should not be for accredited investors only. That is not fair since it robs the small/medium investor from participating in certain investments with upside and downside potential. Too many regulations is not the way to go.
